These terms and conditions ("Terms") govern your use of the services provided by GodSounds, Inc. (doing business as Pneuma Breath) ("we," "us," or "our"), including the Pneuma Breath mobile application, the pneumabreath.com website, and any related services (including free content such as the Seven Days with God series).

1. Acceptance of Terms

By downloading, accessing, or using the Pneuma Breath app, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Services.

2. Account Registration

To access certain features of the Services, you may need to create an account. You agree to provide accurate, current, and complete information during registration and to update your information to keep it accurate and complete.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

3. Subscriptions & In-App Purchases

Certain features of the Services may be offered through paid subscriptions or one-time in-app purchases. By purchasing a subscription or in-app content, you agree to pay the applicable fees as displayed at the time of purchase.

• Billing: Subscriptions are billed in advance on a recurring basis (monthly or annually, depending on your plan). Payment is processed through the Apple App Store.
• Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. You can manage and cancel subscriptions through your Apple ID account settings.
• Refunds: Refund requests are handled by Apple in accordance with their refund policies. We do not process refunds directly.
• Price Changes: We reserve the right to change subscription pricing. Any price changes will take effect at the start of the next billing cycle following notice.

4. Use of Services

You agree to use the Services only for lawful purposes. You shall not:

• Use the Services in violation of any applicable laws or regulations
• Attempt to interfere with, disrupt, or compromise the security of the Services
• Copy, modify, distribute, sell, or lease any part of the Services or its content without authorization
• Use automated systems, bots, or scrapers to access the Services without our written permission
• Reverse-engineer, decompile, or attempt to extract the source code of the Services
• Use the Services to transmit harmful, offensive, or unlawful content

5. Intellectual Property

All content, features, and functionality of the Services, including but not limited to meditations, audio recordings, text, graphics, logos, and software, are owned by GodSounds, Inc. and are protected by copyright, trademark, and other intellectual property laws.

Your subscription or purchase grants you a limited, non-exclusive, non-transferable, revocable license to access and use the content for personal, non-commercial purposes only. You may not reproduce, redistribute, or publicly perform any content from the Services.

6. User Content

If you submit any content through the Services (such as reviews or feedback), you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content in connection with the Services. You represent that you own or have the necessary rights to any content you submit.

7. Privacy

Your use of the Services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

8. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components.

The meditations and content provided through the Services are for spiritual and wellness purposes only and are not intended as a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified health provider with any questions you may have regarding a medical condition.

9. Limitation of Liability

To the fullest extent permitted by law, GodSounds, Inc. and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of or inability to use the Services, even if we have been advised of the possibility of such damages.

Our total cumulative liability to you for all claims arising from or related to the Services shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless GodSounds, Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney fees) arising from your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

We reserve the right to suspend or terminate your access to the Services at any time, with or without cause, and with or without notice. Upon termination, your right to use the Services ceases immediately. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) will remain in effect.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of any material changes by updating the "Last updated" date. Your continued use of the Services after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Services.

13. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or the Services shall first be resolved through good-faith negotiation. If the dispute cannot be resolved informally within thirty (30) days, either party may pursue resolution through the state or federal courts located in Williamson County, Tennessee, and you consent to the personal jurisdiction of such courts.

14. Children

We do not knowingly collect data from or market to children under 18 years of age. If we discover that an account belongs to a user under 18, we will deactivate the account and delete the associated data.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and GodSounds, Inc. regarding your use of the Services, superseding any prior agreements or understandings.
